By accessing or using ThermalStats ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

ThermalStats is a free, community-driven platform that allows users to stress-test their CPUs and GPUs, submit temperature measurements, and compare results against other users with similar hardware. The Service includes a web application and a downloadable CLI tool.

3. User Submissions

• By submitting temperature data, you grant ThermalStats a non-exclusive, royalty-free, perpetual license to use, display, and aggregate your submission data.
• You agree to submit accurate hardware and temperature data to the best of your ability.
• You agree not to submit intentionally false, misleading, or spam data.
• We reserve the right to remove any submission that appears fraudulent or abusive.

4. Data Accuracy Disclaimer

Temperature data is community-contributed and provided "as is" for reference purposes only. ThermalStats makes no guarantees about the accuracy, completeness, or reliability of any temperature data, community averages, or comparisons displayed on the platform. Do not rely solely on ThermalStats data to make hardware purchasing or modification decisions.

5. Stress Testing Disclaimer

Stress tests push your hardware to maximum load. While modern hardware is designed to handle sustained loads, ThermalStats is not responsible for any hardware damage, data loss, or system instability that may result from running stress tests. Use at your own risk.

6. CLI Tool

The ThermalStats CLI tool is open-source software provided under its own license. You use it at your own risk. While we strive to ensure the tool is safe and functional, we make no warranties about its performance or compatibility with your system.

7. Affiliate Links & Advertising

ThermalStats may display product recommendations with affiliate links. We earn a small commission when you purchase through these links at no extra cost to you. Product recommendations are based on your test results and device information and are provided for convenience — we do not guarantee suitability. Advertisements are served by third-party networks and are subject to their own terms and privacy policies.

8. Prohibited Use

• Automated scraping or bulk data extraction without permission.
• Submitting data via automated scripts designed to manipulate averages.
• Attempting to exploit, attack, or disrupt the Service or its infrastructure.
• Using the Service for any unlawful purpose.

9. Rate Limiting

To ensure fair access for all users, the Service enforces rate limits on API endpoints. Exceeding these limits may result in temporary or permanent access restrictions.

10. Limitation of Liability

ThermalStats is provided "as is" without warranties of any kind. To the maximum extent permitted by law, ThermalStats and its operators shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service.
